Website services and SMS messaging terms.

Effective Date: September 14, 2026
Last Updated: September 14, 2026

These Terms and Conditions (“Terms”) govern your access to and use of the NeoMedicine Institute website, online forms, booking tools, communications, and related digital services (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Acceptable Use

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services on your own behalf. You may use the Services only for lawful purposes and in accordance with these Terms.

2. Medical Information and Emergencies

Website content is provided for general informational and educational purposes. It is not medical advice, diagnosis, or treatment and is not a substitute for an evaluation by a qualified healthcare professional. Use of the website alone does not create a physician-patient relationship.

Do not use the website, email, or text messaging for medical emergencies. If you believe you are experiencing an emergency, call 911 or seek immediate emergency medical care.

3. Appointments and Online Requests

An online appointment or consultation request is subject to availability and confirmation by NeoMedicine Institute. Submitting a request does not guarantee an appointment, treatment, eligibility for a service, or a particular medical outcome. We may contact you to obtain additional information, confirm scheduling, or explain next steps.

You are responsible for providing accurate and current contact information. Treatment recommendations and eligibility are determined by a qualified clinician after an appropriate evaluation.

4. Fees, Payments, and Cancellations

Fees, payment terms, deposits, refund rules, and cancellation requirements may be provided during booking or in separate service documents. Those disclosed terms become part of your agreement for the applicable service. Contact NeoMedicine Institute if you need to cancel or reschedule.

5. SMS Messaging Program

Program Description

NeoMedicine Institute operates an SMS messaging program for individuals who affirmatively opt in. Depending on the consent you provide, messages may include:

How to Opt In

You may opt in by providing your mobile telephone number and checking the applicable consent checkbox on a NeoMedicine Institute form or booking flow. Informational and marketing consent are separate when both categories are offered. Consent checkboxes are intended to be unchecked by default. Marketing consent is optional and is not a condition of purchase, booking, or receiving care.

Message Frequency and Charges

Message frequency varies based on your interactions, appointments, and communication preferences. Message and data rates may apply according to your mobile plan. NeoMedicine Institute does not charge a separate fee for SMS messages.

How to Opt Out

Text STOP to opt out. After you send STOP, we may send one final confirmation message. You may need to opt out separately from different programs or message categories if you enrolled in them separately. You may also ask us to stop all text messages by contacting us.

Help and Support

Text HELP for help. You may also call (786) 264-2999 or email hello@neomedicineinstitute.com.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless carrier and is outside our control. Supported carriers and messaging availability may change.

Mobile Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, may be permitted only as necessary to provide those services. All other use-case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. Email and Other Communications

If you elect to receive promotional emails, you may unsubscribe using the link provided in an email. Transactional, administrative, or legally required communications may continue when permitted by law.

7. Intellectual Property

The Services and their content, including text, graphics, photographs, logos, design, and software, are owned by or licensed to NeoMedicine Institute and are protected by intellectual property laws. You may use website content for personal, noncommercial informational purposes only. No other use is permitted without prior written authorization.

8. Third-Party Services and Links

The Services may link to or integrate with third-party websites, scheduling tools, payment providers, maps, social networks, or other services. Their terms and privacy practices govern your use of those services. We are not responsible for third-party content, availability, or practices.

9. No Guarantee of Results

Individual health and wellness outcomes vary. Website descriptions, testimonials, and general information do not promise or guarantee that any service will be appropriate, available, or effective for you. Medical decisions must be based on an individualized professional evaluation.

10. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components. This section does not limit warranties or rights that cannot lawfully be excluded.

11. Limitation of Liability

To the fullest extent permitted by law, NeoMedicine Institute and its owners, clinicians, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the Services. Nothing in these Terms limits liability that cannot lawfully be limited.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless NeoMedicine Institute and its personnel from claims, losses, liabilities, and expenses arising from your unlawful misuse of the Services, your material violation of these Terms, or your infringement of another person’s rights.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy. Medical information may also be governed by our HIPAA Notice of Privacy Practices.

14. Changes to the Services or Terms

We may modify the Services or these Terms from time to time. Revised Terms will be posted with an updated effective date. Changes apply prospectively as provided by law. We may suspend or restrict access to protect users, systems, legal rights, or the integrity of the Services.

15. Governing Law and Severability

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law applies. If any provision is held unenforceable, the remaining provisions will continue in effect.
